Ccigarettes delivery is a growing phenomenon and an increasing portion of overall tobacco sales. While most cigarette sales occur in face-to-face transactions, delivery services enable consumers to order cigarettes by phone, email, facsimile, the internet, and other methods and have them delivered directly to their homes or workplaces by delivery/carrier service.

Currently, several cigarette and vaping delivery apps are available, including Gopuff, Saucey, and others. These services are subject to age verification, local laws, and regional regulations. Moreover, these services are not allowed to sell cigarettes in states where such sales are prohibited by law. Moreover, they must also comply with any local regulations regarding the sale of tobacco products and provide customers with an opportunity to purchase in-state alternative tobacco products.

In addition, some delivery services require a valid government issued photo ID for the customer to sign for the order. Some of these services use a remote ID verification method for confirming that the customer is over 21, while others have the driver verify age at the time of delivery.

The following report identifies state laws that regulate cigarette delivery sales, focusing on state vendor licensure requirements for sellers, labelling and packaging requirements, record-keeping, tax collection, and enforcement provisions. This is the first systematic identification and analysis of state laws addressing delivery sales, and it provides important new information to help inform future policy research aimed at identifying effective cigarette delivery sales policies.
